Guardianship

When an individual is unable to make or communicate decisions about their personal care or finances, a judge may appoint a guardian. In Illinois, guardians may be appointed for both children and adults. These guardianships can encompass management of individuals, known as Guardianship of a Person, as well as management of an individual's estate and finances, known as Guardianship of an Estate.

Adult Guardianship

Adult Guardianship cases involve petitions for Guardianship of the Person as well as petitions for Guardian of both the Person and Estate. In Cook County, Adult Guardianship cases are heard by the Probate Division.

Minor Guardianship

Minor Guardianship cases involve petitions for Guardianship of the Person as well as petitions for Guardian of both the Person and Estate for individuals who are under 18 years of age. These cases are heard by the Probate Division.

Minor Guardianship Help Desk

The Minor Guardianship Help Desk is intended to assist self-represented petitioners seeking to file an action to obtain guardianship of a minor. The Minor Guardianship Help Desk can assist with (1) an application for guardianship of a minor and (2) preparing court documents. Referrals are also provided for more complex cases.
