Petitioning the Court for the Refund or Substitution of a Security or Cash Deposit

At the time the petition is approved, the petitioner must deposit and maintain with the Clerk of the Circuit Court of Cook County the appropriate sum of money pursuant to Rule 9.4(b)(i).  For truck bond certificates, the required sum is $50,000 of which $10,000 shall be in cash and the balance in cash or securities approved by the chief judge.  For automobile bond certificates, the required sum is $25,000 of which $5000 shall be in cash and the balance in cash or securities approved by the chief judge.  Rule 9.4(b)

Refund: After the expiration of one year from the termination of its authority, a guarantor may petition the chief judge for a refund of its security deposit.  Upon the payment of outstanding obligations of the guarantor, if any, the security deposit may be refunded.  Rule 9.4(c).  For an example petition requesting refund of security or cash deposit, click here.

Substitution:  Guarantors may remove a matured security on deposit with the Clerk and substitute a new security in its place.  The guarantor must first deposit the new security before petitioning the court for substitution.  Once the court has approved the substitution, the court will order the release of the matured security on deposit with the Clerk.  For an example petition requesting substitution of security or cash deposit, click here.
